The
Malaysian Bar welcomes the statement by Prime Minister Dato’ Sri Mohd
Najib Tun Abdul Razak (“PM Najib Razak”) that he is the Prime Minister
of “a progressive, liberal nation”. Writing in an opinion piece published
in the Sydney Morning Herald on 27 October 2011, PM Najib Razak went on
to state that, “We are a multi-cultural, multi-ethnic society that has a
long and proud history of social harmony and welcoming outsiders.”
In
Malaysia, the lesbian, gay, bisexual and transgender (“LGBT”) community
has long been treated as “outsiders”, even though they are citizens.
Members of the LGBT community in Malaysia face numerous hardships,
including a lack of personal safety due to harassment by civil and
Syariah authorities, living in fear of prosecution for the private acts
of consenting adults, and constantly facing public discrimination and
denigration. They are perennially at the receiving end of negative
innuendo and hate speech in the mainstream media, which is seemingly
tolerated by the authorities.
The
Malaysian Bar encourages PM Najib Razak to follow up on his words that
Malaysia is a “progressive, liberal nation” and to alleviate the
suffering of members of the LGBT community in Malaysia. He can do so by
quickly introducing laws to remove legislation that impose unwarranted
restrictions on the individual liberties of the LGBT community in
Malaysia.
From 1-13 Nov 2011, the Malaysian Bar is proud once again to support the annual Seksualiti Merdeka series
of events, with this year’s theme of “Queer Without Fear”. We
recognise the LGBT community in Malaysia as one facing persecution on
the basis of sexual orientation and gender identity. No doubt there are
those amongst us who do not agree with the sexual orientations and
gender identities of the LGBT community’s members. But it is precisely
because of this that sexual minorities, and indeed other minority
communities, need to be protected. Individual freedoms and liberties
mean very little if they are only extended selectively, or to those who
agree with the majority view.
PM
Najib Razak wrote in the Sydney Morning Herald that “Malaysia is not
some repressive, backward nation that persecutes refugees and asylum
seekers.” The Malaysian Bar calls on PM Najib Razak to apply the same
thinking with respect to the LGBT community in Malaysia. If PM Najib
Razak seriously wishes to convince his audience in Australia – and
elsewhere in the Commonwealth and the world at large – that Malaysia is a
“progressive, liberal nation”, he must act immediately to end
repression, persecution and prosecution of sexual minorities in
Malaysia.

Respond to Seksualiti Merdeka with wisdom
Press statement by Sisters in Islam - Nov 1, 2011
Sisters in Islam (SIS) is concerned that
Pertubuhan Pribumi Perkasa Malaysia
president Datuk Ibrahim Ali has characterised sexuality rights festival
Seksualiti Merdeka as a “threat to security” (Malaysian Digest, 31 Oct 2011).
As a Muslim women’s organisation, we agree
with Datuk Ibrahim that many Muslims are opposed to affirming sexual diversity
or granting rights to sexual minorities. However, we are also aware that there
are many Muslims who engage in events such as Seksualiti Merdeka in order to
gain a better understanding of gender and sexuality in society. This dialogue,
especially on thorny issues, is important for all Malaysians in our quest to
understand how to manage diversity and disagreement in civil ways. As Allah
says in the holy Quran: “Invite to the way of your Lord with wisdom (hikmah)
and beautiful preaching and argue with them in ways that are best.” (Surah
An-Nahl 16:125)
Furthermore, the reality is that sexual
minorities in Malaysia,
especially Muslims, are vulnerable to numerous abuses by state and community
actors which often threaten their very lives. Surely there must be a more
humane way forward even among Muslims such as Datuk Ibrahim who are opposed to
inclusive sexuality rights.
Nevertheless, we are heartened that Perkasa
has not declared that it will shut down or disrupt the event for now. In fact,
it would be a positive step for Perkasa to air its concerns and seek to address
them through civil and public discussion.

Ermmm, Malaysia is an Islamic country. So, I think it is not worthful to legalize the LGBT in Malaysia. For those who want it, there are a lot of country out there that LGBT is not illegal and accept same sex marriage.
Besides, if being gay is a choice then what about being straight?
Democracy is itself a loose term. Clearly, which country demonstrate the best example of democracy? USA, Western? Do they really? If they are the best of democracy, giving freedom to personal choice and option, why is that when their citizen adopt an islamic way of life and dress code, they went amok? They use everything to shut the muslim lifestyle down. When such things happen they have the guts to say that their country only celebrate mainstream culture; free sex, LBGT etc. When a minority want a different ways they act as if there was no democracy over there. Now we are trying to be the best democratic country when ALL democratic countries are hypocrites, not sparing Singapore as well (If they were ever democratic why don't let the malay have the chance to be PM? huh?). LBGT are not an option in life. These are diseases of end times. Clearly, we are the only animal species that have such problematic dirty sex orientations. No other species demonstrate such irregularities. By that, it should tell us something. Seksualiti Merdeka is really a secular idea. By trying to establish themselves in the community and trying to make people accept them without prejudice is a clear act of alienating religious doctrines. Not a single religion allow such transgressions. They are working to teach the community to throw religion out and embrace their twisted lifestyle. Why? because as long as the community adhere to their respective religion, LBGT has no place in this world. Their war is not against the people but against the religion or more accurately there people are trying to challenge GOD himself. They are challenging GOD to differ in His decrees. Crazy! Look what happen to past nation who tried to fight GOD in their act etc, POMPEII, SADUM, many more. The core trendsetter? LBGT. The day we agree to accept them in our community is the day this country cursed and on the path to destruction. What do we need? Certainly not Seksualiti Merdeka. We need the create facility or department to correct this sick twisted mind. Just like psychiatric treating delusional patient. They are sexual patients. They need psychological adjustment and psychiatric care to point them back to the straight world. They need to be saved, not encourage them to stay sick forever or even abuse them. I do agree that they need passion. Passion to correct their disease, that what it is.
Malaysia is not a democracy country. .
We are Raja Berperlembagaan lah. .
If you really wanna this homosex things,,you can just get out of this WONDERFUL MALAYSIA. .
"If Malaysia wants to be respected as a democracy, it must stop persecuting sexual minorities."
Well, it seems that the alien encroachment of the phrase "sexual minorities' is persecuting the Malaysian unique discourse of the matter. Few days ago David Cameron said that Britain will stop aids to countries that do not overturn bans on homosexuals.
If the countries want to get aids from Britain they must stop 'persecuting' homosexuals. Now Bar Council in Malaysia makes a structurally similar conditional statement "If Malaysia wants to be respected as a democracy, it must stop persecuting sexual minorities." Certainly "being respected as a democracy" and "getting aids" are employed to put Malaysia and those countries in 'either or situation.'
Just like Bush said its either you are with me or with the terrorists. This is cultural imperialism, that cunningly employs keywords "sexual minorities' and 'persecution' as pretexts for intrusion. This is not just a Malaysian predicament. This is a global contest over values. You have chosen your side BAR council.
Dear Somebody,
Can you not play with the religion on the issue of LGBT furthermore, please read the constitution first before mentioning Malaysia is an Islamic country but we are a secular nation.

Malaysia is one of the many countries signed the Universal Decalaration of Human Rights (UDHR), which has endorsed the LGBT same equal rights.
Can i ask you not to be a straight men? Think about it.
My only contention is that "Sisters in Islam" use Quranic verses while conveniently leaving out the most obvious verses
(7:80)
And [We had sent] Lot when he said to his people, "Do you commit such immorality as no one has preceded you with from among the worlds?
(7:81)
Indeed, you approach men with desire, instead of women. Rather, you are a transgressing people."
Please relay this to Sisters in Islam.
This is ridiculous. We are just moving backwards by imposing such bans.Leaving in denial about the fact that LGBT does community exist in our country does not make you a better government. Not giving them their freedom of speech is not going to make our country any better. In fact its going to make things worse.
I strongly condemn what Hizbi UK Eire said above.
LGBT do exist in Malaysia..i admit...but instead of supporting their condition to keep building up in their self...we are suppose to help treat them to be back to normal...Hizbi UK Eire was right...humans are the only creature on earth that keeps destroying themselves and others around...from abnormal sexuality to war and destruction...we were born with a brain to differentiate rights and wrongs compared with other creatures...yet we tend to always choose the wrongs and use natural instinct as an excuse..u are not born as an LGBT...its either a wrong up bringing or u urself choose to b an LGBT due to influences from ur frens and surroundings...its a sickness...a psychological sickness that need to be cured...a civilization could be crushed due to such sickness and dont start denying it...many civilization in the past has been doomed due to this so called freedom of sexuality you keep on fighting for....c'mon...if you really want such freedom...migrate to other countries that legalize your freedom of sexuality thingy...i dont want my beloved country to be doomed...
being LGBT is not a disease nor it is a psychiatric illness. medical associations around the world have long recognise that LGBT is part of human sexuality and is as "normal" as heterosexuality. it is part of human sexuality. to those who mention that in animal kingdom, there are no occurence of homosexulaity, please do your research before you spit out hate. and by the way, not all religion in the world condemn LGBT. just speak for on behalf of your interpretation of your religion instead of generalizing religion in whole.
